The Occupational Health and Safety Administration (OSHA) describes asbestos as a group of minerals resistant to heat and corrosion. In 1924, cotton mill worker Nellie Kershaw was the first known person to die from a history of asbestos exposure. Her employer followed no safety precautions and offered no protective gear. Kershaw was 33 years old when she died after years of exposure to asbestos dust. Her family did not receive compensation from her employer during her lifetime.
The United States Navy was just one of many official government organizations that knew about the dangers of high levels of asbestos exposure but chose not to release this information to the public. Asbestos mass torts did not begin in the United States until the 1960s.
The tide began turning in 1966 when the government amended Rule 23 of the Federal Rules of Civil Procedure. The change established several criteria for class-action lawsuits, which had previously been so vague it was nearly non-existent. People could now file larger lawsuits for lung cancer, mesothelioma, pleural effusion, and other health problems caused by asbestos exposure and employer or manufacturer negligence. The new law also helped force social change surrounding asbestos use and mesothelioma cases.
In 2022, the typical settlements for asbestos-related diseases and mesothelioma are between $1 million and $5 million. Trial verdicts are typically much larger for cancer and other health problems caused by past asbestos exposure.

On August 5, 2021, Bloomberg Law reported that a jury in Alameda County, California, awarded Teresa Elizabeth Leavitt a $29 million settlement due to her mesothelioma case caused by years of using Johnson & Johnson Baby Powder containing dangerous levels of talc. Leavitt stated that she developed slow-growing mesothelioma after her mother used the powder on her as an infant, and she continued to use it herself for over 30 years. The jury found Johnson & Johnson liable for design defect, failure to warn, concealment claims, and negligence. Leavitt received her mesothelioma diagnosis in 2017.
Auto mechanic case
On July 2, 2021, Steven Aaron, Sr., who goes by Joe, received a jury verdict in his favor for $8.2 million from the Ford Motor Company. Aaron developed malignant mesothelioma due to asbestos exposure he did not even know about in the 1960s and 1970s when he worked as a brake clutch repairman servicing brakes on Ford vehicles. The asbestos was deep in the brake pads, and Aaron did not know the health risks he faced every day. His malignant mesothelioma diagnosis came in 2020, more than 50 years after the asbestos exposure.
Los Angeles case
A jury in Los Angeles awarded a 78-year-old man a $4.8 million settlement in April 2021 after he developed mesothelioma due to long-term use of a talcum powder. Willie McNeal, Jr. received a diagnosis of pleural mesothelioma, a type of lung cancer caused by asbestos exposure. In the pleural mesothelioma case, the defendant, Whittaker, Clark & Daniels, extracted talc from a mine in North Carolina known for asbestos contamination.
Ohio case
The trial lawyers of Simon Greenstone Panatier secured a jury verdict of $12.1 million on behalf of an 83-year-old Korean War veteran in June 2021. The award included $6 million in punitive damages against product manufacturer John Crane, on top of the original $6.1 million verdict. Robert Mitchell worked for the company for 40 years shipping glass-coated bowls used in pharmaceutical and chemical manufacturing.
Mitchell inhaled asbestos particles in the air after using a bandsaw to cut packing rope. His employer never provided any warnings or protective equipment in the four decades he worked for them. However, that is only because the employer also remained unaware of the asbestos exposure danger. John Crane paid damages to Mitchell’s brother, James Mitchell, his only survivor. Robert Mitchell received a mesothelioma diagnosis in 2016 and died later that year.

With low levels of asbestos present in soil, air, and water, all people face asbestos exposure at some point in their lives. Most people do not become ill from occasional exposure. - Pennsylvania
- Michigan
The rate of asbestos cases in West Virginia is 696.3 for every 100,000 people. Utah ranks lowest with 362.2 asbestos cases for every 100,000 people.
The National Cancer Institute states that no safe threshold for asbestos exposure exists that has been established for lung cancer and mesothelioma. These are the most common fields where people have frequent exposure to asbestos fibers:
